BITTEN BY NEIGHBOR’S DOG THAT ESCAPED THROUGH FENCE
While sitting on her back porch with her dog, our client heard another dog barking and banging itself against the fence between her property and her neighbor’s property. The dog in the neighboring property continued to bang against the fence. Shortly after, our client heard a wooden plank crack, and when she looked towards the fence, she saw two planks of the wooden fence break.
Alarmed at the broken fence, she called her own dog to go inside. As she did this, a pit bull mix and another dog walked through the break in the fence. The pit bull proceeded to the porch and attacked our client’s dog.
As our client attempted to lift her dog into her arms, the pit bull clamped it’s jaws onto our client’s right hand.
Another occupant of the house heard the commotion and rushed to attempt to remove the dog from our client’s hand. As he fought to free our client’s hand from the dog’s jaws, the dog then bit down on his right arm, injuring this second person.
After they had gotten the dog to release its grip, the police and emergency services arrived and took our client to a medical center for treatment.
In this case, our client sought compensation from the owner of the escaped dog because the dog was confined to his property in such a way that it had access to our client’s yard. The fence was not secure, and the dog was able to scratch and chew a hole in the fence to gain access to our client’s property. Taking all this into account, the owner of the pit bull did not take proper measures to secure their dog.
