PEDESTRIAN HIT WHILE CROSSING ROAD IN DENVER, CO
Our client, a high school student in Denver, Colorado, exited the school bus and began walking home. She walked along South Havana Street until she reached the intersection with East Girard Avenue. At the same time, a commercial vehicle operator driving in the course and scope of his employment was traveling eastbound on East Girard Avenue, approaching the intersection with South Havana Street.
When our client reached the intersection with East Girard Avenue, she waited at the crosswalk for the signal to change so she could cross South Havana Street. When the signal changed to the walk sign, our client began crossing the intersection. Unfortunately, the driver was not paying proper attention and decided to make a left turn on a red light. He struck our client when she was nearly halfway through the intersection, sending her crashing into the ground.
Our attorney argued that our client’s injuries were the direct result of the negligent actions of the driver, including:
- Ignoring a red light;
- Refusing to yield the right-of-way to a pedestrian;
- Maintaining an unsafe distance from other vehicles;
- Keeping an improper lookout;
- Traveling at an unreasonable speed given the circumstances;
- Making an untimely and improper application of his brakes;
- Exhibiting inadequate driver attention;
- Driving distracted
- Taking improper evasive actions to avoid the collision; and
- Choosing to violate safety rules.

FREQUENTLY ASKED QUESTIONS
Below are some frequently asked questions related to pedestrian accident cases.
Q: How do I know if I have a pedestrian accident case?
A: Whether or not you have a pedestrian accident case will depend on three factors.
- 1. You want to see whether or not you have liability facts. Liability facts allow you to hold the person who injured you responsible for your injuries.
- 2. You want to see whether or not you have sufficient damages that make it worth your time and hassle to go through with filing a claim for a personal injury. Damages include things like your medical bills from the injury, your lost wages, as well as your pain and suffering.
- 3. You want to see whether or not there is a source of recovery, which usually means some sort of insurance policy that will cover the negligent actions of the person who injured you.
Q: What compensation may I seek?
A: If you were injured in an accident, the compensation you may be entitled to can include:
- medical expenses;
- future medical expenses;
- lost wages;
- future lost wages;
- loss of future earning capacity; and
- pain and suffering and emotional distress.
As this is not a definitive list, speak with an attorney to find out more about the compensation to which you may be entitled.
