Laws regarding workers’ compensation for Uber drivers vary from state to state. Generally, workers labeled as employees are eligible for workers’ compensation while independent contractors are not. Uber drivers are usually considered independent contractors and are therefore not eligible for workers’ compensation. If you are an Uber driver and you were injured on the job, you should hire an experienced personal injury lawyer to handle your case. Filing a personal injury claim for a work-related injury as an independent contractor can be challenging, but your attorney may be able to help you seek the compensation you may be entitled to.

Available 24 / 7|Free Consultation1. Seek Medical Attention
If you are an Uber driver and you sustained an injury from a work-related accident, the first thing you should do is seek medical attention. If there are other passengers in the vehicle, stay with them until help arrives. You should seek medical attention immediately following an accident whether your injuries are apparent or not. Some injuries are not immediately noticeable but may require treatment. Seeking medical treatment after your accident will be beneficial to you regarding both your health and any potential injury claim.
2. Contact Local Authorities
After seeking medical attention, you should also contact local authorities. Law enforcement may arrive and complete an accident report after taking statements from involved parties and any witnesses. This accident report may help support your claim against the at-fault party.
3. Document the Incident
Collecting as much evidence as possible from the scene of your accident is very important. You should take pictures and/or videos and record statements and contact information from eyewitnesses. If you are able to, you should also take a screenshot of which period of the Uber ride you were in when the accident occurred. You should also write down a detailed account of the accident to the best of your memory. It is important to do this while the details of the accident are fresh in your mind. In addition to documenting evidence from the accident scene, you should maintain a record of any losses or damages you experienced as a result of the accident including the cost of any repairs, replacements, and medical expenses.
4. Contact a Rideshare Lawyer
As soon as you can, you should hire an experienced Uber driver personal injury attorney to handle your Uber driver injury claim. Because you are likely classified as an independent contractor, you may not be eligible for worker’s compensation for any injuries you may have sustained while driving for Uber. However, your attorney may still be able to help you seek the compensation you deserve. Be sure to provide your lawyer with all of the evidence you collected at the scene of the accident and after the accident, including any pictures, videos, eyewitness statements, and receipts or invoices from costs you incurred as a result of the accident. Having that documentation available for your attorney can help your rideshare driver personal injury attorney build the strongest case possible to help you seek compensation.

CAN I FILE A CLAIM IF I AM HURT DRIVING FOR UBER?
Uber drivers are independent contractors, and therefore are not provided with typical employment benefits, such as workers’ compensation and health insurance. Usually, independent contractors do not receive coverage from a company insurance policy. However, Uber does offer insurance policies for its drivers. cover drivers only while they are actively working for Uber. Coverage is offered for drivers while they are waiting for a ride request, driving to pick up a passenger, and while the passenger is riding in the car. When drivers have their Uber app on, their coverage includes at least $50,000 in injury liability per individual $100,000 in total liability per incident, and $25,000 in property damage coverage. If the driver has a passenger in the vehicle, coverage increases to a total of $1 million in liability. If the driver is in an accident while not logged into the Uber app and actively working for Uber, he or she will often have to rely on personal insurance coverage.

WHO IS LIABLE IF I AM HURT DRIVING FOR UBER?
Liability also depends heavily on how the accident occurs. If the accident is the fault of the Uber driver, he or she will most likely be held liable and have to rely on coverage from a policy offered by Uber. If the accident is the fault of another party, they may be held liable for any damages. If the accident was not the fault of any specific party and occurred as a result of natural or unforeseeable consequences such as inclement weather, the driver will likely have to rely on coverage from an Uber policy.
The Other Driver
As with most car accidents, if the other driver was responsible for causing the accident, you may be able to pursue compensation from that driver as they will generally be liable for any injuries or damages you suffered as a result of the accident.
Passenger or Passengers
It is also possible for an accident to be the fault of a passenger. If an Uber driver has a passenger who is intoxicated to the point of behaving recklessly, violent or belligerent, or engages in any other behavior that is distracting to the driver which causes an accident, the passenger could be deemed liable for any injuries or damages that result from the accident.
Uber
It is often difficult to sue Uber after an accident. However, you may be able to sue Uber if you are able to prove some sort of misconduct on Uber’s part. However, an experienced lawyer may be crucial in attempting to pursue any claim against Uber.
WHAT SETTLEMENT VALUE CAN I GET?
Each Uber driver injury claim is unique; therefore, each settlement may be worth a different amount. The amount that your settlement is worth depends heavily on the nature of the accident, such as the severity of injuries and the cost of medical expenses, the extent of losses or damages, and who was deemed liable for the accident. You may be able to receive economic damages, such as:
Medical Bills
You may be entitled to compensation for any medical bills or expenses you have suffered as a result of the accident. This generally includes the cost of any hospital stays or treatment, ambulance trips, any physical therapy, medication, or other medical expense related to your injuries suffered in the accident.
Lost Income
In addition to medical expenses, you may also be entitled to compensation for lost wages. Lost wages compensate you for time you missed from work due to the accident.
Loss of Earning Capacity
You may also be able to seek compensation for any loss of earning capacity if you are temporarily or permanently disabled. If your injuries prevent you from being able to earn income at the same level as you could before the accident, you may be entitled to compensation for the loss of earning capacity. For example, if your injuries prevent you from continuing to drive for Uber while also preventing you from being able to earn a similar level of income elsewhere, this may entitle you to compensation.
You may also be entitled to non-economic damages, including:
Pain and Suffering
You may be able to pursue compensation for any pain and suffering that you endured as a result of your injuries. This pain and suffering may apply to the pain experienced immediately after the accident as well as its impact on your daily life. For example, if you suffered broken legs or a hip, you may be able to seek compensation for the ongoing pain you suffer as you go through physical therapy and continue to heal.
Emotional Distress
Finally, you may also be eligible for compensation for any emotional distress or mental anguish caused by the accident. For example, some accident victims may suffer some level of PTSD or other emotional distress after being in a traumatic event.
If you are in an accident, gathering evidence from the scene of the incident can help prove liability. You should seek counsel from an experienced Uber accident attorney to handle your case. He or she may be able to help determine who is responsible for your accident and help you seek compensation.
