There are some scenarios when a lifeguard is not required to be on duty. In these cases, pool managers are required to provide the necessary warning signs for pool patrons. If there is missing information or lack of warning signs, then there may be potential to file suit. Warning signs include warnings such as “no diving,” listing the water depth, warning against running on wet cement and warning against leaving children unsupervised. Even when a lifeguard is on duty, accidents can still occur.
If a lifeguard is on duty, but they fail to take notice of a swimmer in distress, the lifeguard could be held responsible for that injury or death. If a pool manager let swimmers into the pool without a lifeguard on duty when there should have been, this could present liability issues. Poor hiring practices can also lead to liability. When establishments with pools hire people who do not have the proper training or necessary certifications, the establishment could be found to have been careless in their hiring practices.
