According to the Centers for Disease Control and Prevention, about ten people die on a daily basis from drowning Sadly enough, many of these are children under the age of 14. This is a huge problem in the United States, since drowning is statistically one of the leading causes of accidental death. While many of these accidents take place at beaches, lakes and even in bath tubs, many take place at public swimming pools. Swimming pool accidents can have a variety of causes, and depending on the cause, the victims of these accidents may be able to file lawsuits so that they can be compensated.
POOL DEFECTS & DANGEROUS CONDITIONS
Defective products are one major cause of swimming pool accidents. There is an entire market for pool products, many of which can pose a danger to swimmers. Pool toys such as slides, hoses for cleaning pools and broken or improper drain caps can all be causes for concern. If a drain cap is missing or broken, for example, the suction can be strong enough to hold a child or adult at the bottom of the pool until they drown. There are also many dangerous conditions at swimming pools that could be cause for concern. For example, broken pool tiles, broken diving boards and even slippery cement can present liability issues. Swimming pool owners must take care to make sure that the conditions at their pools are as safe as they possibly can, because they have a duty to care for those who visit their establishment.

There are some scenarios when a lifeguard is not required to be on duty. In these cases, pool managers are required to provide the necessary warning signs for pool patrons. If there is missing information or lack of warning signs, then there may be potential to file suit. Warning signs include warnings such as “no diving,” listing the water depth, warning against running on wet cement and warning against leaving children unsupervised. Even when a lifeguard is on duty, accidents can still occur.
If a lifeguard is on duty, but they fail to take notice of a swimmer in distress, the lifeguard could be held responsible for that injury or death. If a pool manager let swimmers into the pool without a lifeguard on duty when there should have been, this could present liability issues. Poor hiring practices can also lead to liability. When establishments with pools hire people who do not have the proper training or necessary certifications, the establishment could be found to have been careless in their hiring practices.
